If Ofcom1 is satisfied that the holder of a licence under Part I of the Broadcasting Act 19902 or a digital programme licence under Part I of the Broadcasting Act 19963 has failed to comply with the restrictions on broadcasting listed events4, and is not satisfied that in all the circumstances it would be unreasonable to expect him to have complied5, it may require him to pay, within a specified period, a specified financial penalty to Ofcom6.
