A person who commits an offence under Part 5 of the Wireless Telegraphy Act 20061 is liable, on summary conviction, to imprisonment for a term not exceeding 12 months or to a fine not exceeding the statutory maximum2 or to both; and, on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine or to both3. Proceedings in England and Wales for such an offence may be brought only by Ofcom4 or by or with the consent of either the Secretary of State5 or the Director of Public Prosecutions
