39. Ofcom's powers to share information to avoid undue interference with wireless telegraphy.

Ofcom1 may require:

  1.  

    (1)     a person who is using, or has established or used, a wireless telegraphy station2; and

  2.  

    (2)     a person who is using, or has installed or used, wireless telegraphy apparatus3,

to provide a person registered under the Wireless Telegraphy Act 20064 as a provider of dynamic spectrum access services5 with all such information as Ofcom considers necessary and proportionate for the purpose of enabling the registered person to avoid undue interference with wireless telegraphy6. A demand for the required information must be contained in a notice given to the person from whom the information is required7.
