67. Ofcom's powers to authorise spectrum trading.

Ofcom1, in performing its general duties2, must have regard, where relevant in the circumstances, to the desirability of promoting competition in relevant markets, and encouraging investment and innovation in therm3.

To this end, Ofcom may by regulations4 authorise the transfer to another person by the holder of a wireless telegraphy licence5, or the holder of a grant of recognised spectrum access6, of rights and obligations arising as a result of such a licence or grant7.
