252. Ofcom's power to suspend licence for inciting crime or disorder.

If Ofcom1 is satisfied that:

  1.  

    (1)     the holder of a licence2 granted under Chapter II of Part III of the Broadcasting Act 1990 (which governs sound broadcasting services)3 has included in the licensed service4 one or more programmes5 containing material likely to encourage or incite the commission of crime or to lead to disorder6;

  2.  

    (2)     in doing so, the licence holder has failed to comply with a condition7 included in the licence which applies the regulatory regime for the licensed service8; and

  3.  

    (3)     the failure would justify the revocation of the licence9,
