If Ofcom1 is satisfied2:
(1) that the holder of a licence3 granted under Chapter II of Part III of the Broadcasting Act 1990 (which governs sound broadcasting services)4 is failing to comply with any condition of the licence or with any direction given by Ofcom under or by virtue of any provision of Part III of the Broadcasting Act 19905 (which governs independent radio services generally); and
(2) that that failure, if not remedied, would justify the revocation of the licence,
Ofcom must serve on the holder of the licence a notice6, which must:
(a) state that Ofcom is satisfied
