Ofcom1 is under a statutory duty to do all that it can to secure that the holder of every Broadcasting Act licence (which includes a multiplex licence)2 complies, in relation to the licensed service, with the conditions included in the licence3.
If Ofcom is satisfied that the holder of a multiplex licence has failed to comply with any condition of the licence or with any direction given by Ofcom under or by virtue of any provision of Part I of the Broadcasting Act 19964, it may serve on him5:
(1) a notice requiring him to pay, within a specified period,
