For the purposes of Part I of the Broadcasting Act 19901, 'additional service' means any service which consists in the sending of electronic signals2 for transmission by wireless telegraphy3 by means of the use of the spare capacity within the signals carrying any television broadcasting service4 provided on a relevant frequency5.
For these purposes, the spare capacity within the signals carrying any such broadcasting service is taken to be any part of the signals which:
(1) is not required for the purposes of the television broadcasting service for the purposes of which the frequency has been made available; and
