A person who has a wireless telegraphy station1 or wireless telegraphy apparatus2 in his possession or under his control commits an offence if: (1) he intends to use it in contravention of the requirement3 to obtain a wireless telegraphy licence4, unless the establishment, installation or use of the station or apparatus in question is exempted5 from the requirement6; or (2) he knows, or has reasonable cause to believe, that another person intends to use it in contravention of that requirement7, and is liable as follows:
(a) a person who commits such an offence consisting in the establishment or use
