Ofcom1 is under a statutory duty to do all that it can to secure that the holder of every Broadcasting Act licence (which includes a digital programme licence2) at all times holds his licence on the conditions which are for the time being included in the regulatory regime for the licensed service3.
If Ofcom is satisfied that the holder of a digital programme licence has failed to comply with any condition of the licence or with any direction given by Ofcom4, it may serve on him5:
(1) a notice requiring him to pay, within a specified period, a specified financial
