For the purposes of the Obscene Publications Act 1959, the circumstances in which a person publishes an article are extended to include any matter that is recorded on an article which is included by him in a programme included in a programme service ('live programme material')1; and where the inclusion of live programme material would, if that matter were recorded matter, constitute the publication of an obscene article for the purposes of the Obscene Publications Act 1959, that Act has effect in relation to the inclusion of that matter in that programme as if it were recorded matter2.
