A radio multiplex licence1 must include such conditions as appear to Ofcom2 to be appropriate for securing3:
(1) that the licensed service4 is established by the licence holder5 in accordance with the timetable and other proposals indicated in the technical plan submitted by him in response to the tender notice6;
(2) the implementation of any proposals submitted by the licence holder in response to the tender notice7;
(3) that all digital sound programme services8 broadcast9 under the licence are provided10:
(a) in the case of a national radio multiplex licence, by the holder of a national digital sound programme
