For the purposes of Part IV of the Broadcasting Act 19961, television programme services2 and EEA satellite services3 are to be divided into two categories as follows4:
(1) those television programme services and EEA satellite services which for the time being satisfy the qualifying conditions5; and
(2) all other television programme services and EEA satellite services6.
The qualifying conditions, in relation to a service, are7:
(a) that the service is provided without any consideration being required for reception of the service8; and
(b) that the service is received by at least 95 per cent of the population of the United
