Ofcom1 may, when awarding a multiplex licence2 to any person, make the grant of the licence to him conditional on his compliance before the grant with such specified requirements relating to the financing of the service as appears to it to be appropriate, having regard to3:
(1) any duties which are or may be imposed on Ofcom, or on the licence holder, by or under the Broadcasting Act 1990, the Broadcasting Act 1996 or Part 3 of the Communications Act 20034; and
(2) any information provided to Ofcom during the application procedure5 by the person to whom the licence
