Ofcom1, after considering all the cash bids2 submitted by the applicants3 for a Channel 3 licence4, must award the licence to the applicant who submitted the highest bid5. Where two or more applicants for a particular licence have submitted cash bids specifying an identical amount which is higher than the amount of any other cash bid submitted in respect of the licence, then Ofcom must invite those applicants to submit further cash bids in respect of that licence6.
Ofcom may, however, award the licence to an applicant who has not submitted the highest bid7 if it appears to it that
