Where Ofcom1 proposes to grant a licence2 to provide a national radio multiplex service3, it must publish, in such manner as it considers appropriate, a notice (a 'tender notice')4:
(1) stating that it proposes to grant such a licence5;
(2) specifying the frequency6 on which the service is to be provided7;
(3) specifying, in such manner as Ofcom considers appropriate, the area of the United Kingdom8 in which the frequency is to be available9;
(4) where digital capacity on the frequency is reserved10 for the broadcasting11 of a simulcast radio service12, stating that fact and specifying the capacity reserved
