Where Ofcom1 proposes to grant a licence to provide additional services2, it must publish, in such manner as it considers appropriate, a notice (a 'tender notice')3:
(1) stating that it proposes to grant such a licence4;
(2) specifying the television broadcasting service (or services)5 on whose frequency (or frequencies)6 the services are to be provided7, and specifying the extent and nature of the spare capacity8 which is to be allocated by the licence9;
(3) inviting applications for the licence and specifying the closing date
