It is an offence for a person to act as director of a company1 or directly or indirectly to take part in or be concerned in the promotion, formation or management of a company, without the permission of the court, at a time when: (1) the person is an undischarged bankrupt; (2) a moratorium period under a debt relief order applies in relation to the person2; or (3) a bankruptcy restrictions order or undertaking3 or a debt relief restrictions order or undertaking4 is in force in respect of the person5.
