132. Liquidated sum.

A covenant to pay the excess of debts due from a firm over debts due to it is not a covenant to pay a liquidated sum1. A claim arising from a failure to redeliver shares lent by one person to another has been held not to be a 'debt or sum of money due or claimed to be due'2; nor is there a debt due in respect of a liability under a bond of indemnity as to costs3. The amount of differences fixed under its rules by the default official, due to a stock exchange creditor by a defaulter,
