140.     Executors.

One of several executors may present a petition in respect of a debt due to the executors1. An executor may present a petition against a debtor to the deceased before taking out a grant of probate2; but it is doubtful whether an executor may secure a bankruptcy order before probate has been obtained3. Where a petitioning creditor dies before a bankruptcy order is made, his executor may apply to carry on the proceedings4.
