A bankrupt's creditors may, in accordance with the Insolvency (England and Wales) Rules 20161, establish a committee (known as 'the creditors' committee') to exercise the functions conferred on it by or under the Insolvency Act 19862. The bankrupt's creditors may not, however, establish such a committee, or confer any functions on such a committee, at any time when the official receiver is the trustee of the bankrupt's estate, except in connection with the appointment of a person to be trustee instead of the official receiver3.
