828. Bankruptcy offences.

The following provisions apply where the court has made an insolvency administration order1; and they apply whether or not the insolvency administration order is annulled, but proceedings for an offence may not be instituted after the annulment2.

A person is guilty of an offence if, in the 12 months before the date of death of the deceased debtor, he acquired or received property from the deceased debtor knowing or believing that the deceased debtor owed money in respect of the property, and that the deceased debtor did not intend, or was unlikely to be able, to pay the money he
