343. Application to court by a creditor or a bankrupt on grounds that remuneration or expenses excessive.

Any secured creditor1, or any unsecured creditor with either the concurrence of at least 10 per cent in value of the creditors (including that creditor) or the permission of the court may apply to the court for an order2.

Application by a creditor may be made on the grounds that the remuneration charged, or the expenses incurred, by the trustee are in all the circumstances excessive or the basis fixed for the trustee's remuneration3 is inappropriate4. The application by a creditor must be made no later than eight weeks after receipt by the applicant of the progress report5 or final
