Where a bankrupt applies for an annulment of a bankruptcy order1, the application must be supported by a witness statement2 stating: (1) that the voluntary arrangement has been approved by the creditors3; (2) the date of the approval; and (3) that the 28 day period for applications to be made4 has expired and no applications or appeal remain to be disposed of5.
The application and witness statement must be filed with the court and the court must deliver a notice of the venue6 for the hearing to the bankrupt7.
