In a claim against a custodian founded on the custodian's breach of the duty of care, the measure of damages recoverable is generally the actual value of the chattel where it is lost or destroyed, and its diminution in value where it is damaged1. However, the claimant may also, in particular cases, be entitled to recover the cost of reinstatement and any consequential damage flowing from the negligence which is not too remote in law, which may include damages for loss of use of the chattel2, or profits lost from the destruction of it
