The Secretary of State1 may make regulations relating to the provision of accommodation in aircraft2.
In the United Kingdom3, a person must not make available flight accommodation4 unless that person is5:
(1) the operator6 of the relevant aircraft7;
(2) an ATOL holder8 acting in accordance with the terms of its ATOL9; or
(3) a person who is exempt10 from the need to hold an ATOL11;
A person must not in the United Kingdom:
(a) hold themselves out as a person who may make available flight accommodation unless12:
(i) they may make available that flight accommodation under heads (1) to (3)13; and
