The pilot in command1 of an aircraft2 other than a balloon must ensure that prior to and during taxiing, take-off and landing, and whenever deemed necessary in the interest of safety, each passenger on board occupies a seat or berth and has their safety belt3 or restraint device properly secured4.
During flight, the pilot in command must keep any safety belt fastened while at the pilot's station5 and must remain at the controls of the aircraft at all times except if another pilot is taking the controls6. If the aircraft is required by or under the Air Navigation Order 20167
