Any person (other than the operator1 of the relevant aircraft or an airline ticket agent2) who makes available flight accommodation3 to a consumer4:
(1) on its own5,
(2) as a component of a package6, or
(3) as a component of a Flight-Plus7,
must supply an ATOL Certificate8 to the consumer by the specified method9 when the person:
(a) accepts a first payment, whether in part or in full, for flight accommodation10;
(b) makes a booking for the flight accommodation requested by the consumer where payment for such flight accommodation is made by the consumer to the aircraft operator or another
