Where a reportable occurrence1 of a prescribed description2 has happened which comes to the attention of a person in the exercise of his functions it must be reported to the Civil Aviation Authority ('CAA')3 by every such person who is:
(1) the pilot in command4, or, in cases where the pilot in command is unable to report the occurrence, any other crew member5 next in the chain of command of an aircraft registered in a member state or an aircraft registered outside the EU but used by an operator for which a member state ensures oversight of operations or
