A crew member1 may present a complaint to an employment tribunal that his employer2 has refused to permit him to exercise any right he has to annual leave3, free health assessment4, transfer from night work5 or in relation to patterns of work6. An employment tribunal may not consider a complaint unless it is presented:
(1) before the end of the period of three months beginning with the date on which it is alleged that the exercise of the right should have been permitted (or in the case of a rest period7 or
