Aircraft used by a Community air carrier1 must be registered, at the option of the member state whose competent authority issues the operating licence2, in its national register or within the EU3. For these purposes4 the Secretary of State5 must decide whether aircraft used by an air carrier that holds an operating licence issued by the Civil Aviation Authority ('CAA')6 are to be registered in the United Kingdom7 national register or within the EU8. An operating licence is not valid for the purpose of enabling an air carrier that holds an operating licence granted by the CAA to use
