Where the holder of an air transport licence or route licence1 (the 'applicant') applies to the Civil Aviation Authority ('CAA')2 for the variation of a licence held by another person (the 'respondent') in order to restrain him from engaging in behaviour damaging to the applicant's business, he may require in view of the urgency of the matter a preliminary hearing of the application so that his competitor's licence is provisionally varied pending the hearing3.
