761. Power of the Secretary of State to give directions as to the Civil Aviation Authority's powers and duties.

The Secretary of State1 may give directions to the Civil Aviation Authority ('CAA')2 imposing duties or conferring powers (or both) on it with regard to air navigation in a managed area3. No action is to lie in respect of a failure by the CAA to perform a duty imposed on it by such a direction; but that does not affect a right of action in respect of an act or omission which takes place in the course of performing the CAA's air navigation functions
