The operator1 of an aircraft registered in the United Kingdom2 which is3:
(1) flying on a public transport flight4;
(2) operated by the holder of a national air operator's certificate5;
(3) a helicopter flying on a commercial air transport operation6; or
(4) an aeroplane with a flight crew7 of one pilot flying for the purpose of commercial air transport8,
may not cause or permit that aircraft to make a flight unless9 he has established a scheme for the regulation of flight times for every person flying in that aircraft as a member of its crew10. The scheme must be approved
