No relevant record1 may be made available by the Secretary of State2 to any person for purposes other than accident or incident investigation3 but this does preclude the Secretary of State making a relevant record available to any person where:
(1) in a case where that person is a party to or otherwise entitled to appear at judicial proceedings4, the relevant court5 has ordered that the relevant record must be made available to him for the purpose of those proceedings6; or
(2) in any other circumstances, the relevant court has ordered that the relevant record must be made available
