A dry lease agreement1 to which a Community air carrier2 is a party or a wet lease agreement3 under which the Community air carrier is the lessee of the wet-leased aircraft must be subject to prior approval in accordance with applicable EU or national law on aviation safety4.
A Community air carrier wet leasing aircraft registered in a third country from another undertaking must obtain prior approval for the operation from the competent licensing authority5.
