By virtue of his lien1 and special property an auctioneer2 can maintain a claim for trespass3 or conversion4 against persons wrongfully interfering with or converting goods5. He has, however, no such property in, or right of claim in respect of, unsevered fixtures because these are land and an auctioneer employed to sell such fixtures has only a right to detach and remove them and not, before such severance, possession of them6.
