593. The 'qualifying offences'.

The 'qualifying offences' for the purposes of the provisions relating to retrial1 are2:

  1.  

    (1)     assisting an enemy3;

  2.  

    (2)     surrendering any place or thing to an enemy etc4;

  3.  

    (3)     obstructing operations5 where the offence relates to an action or operation against an enemy; and

  4.  

    (4)     an offence of criminal conduct6 as respects which the corresponding offence under the law of England and Wales is:

    1.  

      (a)     murder or attempted murder7;

    2.  

      (b)     soliciting murder8;

    3.  

      (c)     manslaughter9;

    4.  

      (d)     kidnapping10;

    5.  

      (e)     rape or attempted rape11;

    6.  

      (f)     assault by penetration12;

    7.  

      (g)     rape or attempted rape of a child under 1313;
