In proceedings where the Court Martial1 consists of a judge advocate2 and lay members3, a prescribed number4 of the lay members must be officers or warrant officers qualified for membership5 and not ineligible for membership6, and the rest must be officers so qualified and not ineligible7.
The qualification and eligibility criteria above for lay members do not apply in the following proceedings8 where each of the lay member is either: (1) a person not subject to service law who is qualified for membership9 and not ineligible for membership10; or (2) an officer or warrant officer who would otherwise be qualified
