Where a charge is to be heard summarily1 by a commanding officer2, he may, before or after the start of any summary hearing3: (1) amend the charge4; (2) substitute another charge for it5; (3) bring an additional charge6; (4) discontinue proceedings on the charge7; (5) refer the charge to the Director of Service Prosecutions8. If the charge has been allocated for summary hearing9, the accused's commanding officer must hear the charge summarily unless he exercises his powers10 of substitution of another charge, discontinuing the proceedings or referring the charge to the Director of Service Prosecutions
