As from a day to be appointed1, the Court Martial or the Service Civilian Court2 may make an order where: (1) it deals with a defendant3 in respect of a sexual offence4 of which the defendant has been convicted or found not guilty by reason of insanity; and (2) it is satisfied that it is necessary to make an order for the purpose of protecting the service community5 outside the United Kingdom from serious sexual harm6 from the defendant7.
