An appeal lies to the Supreme Court3, at the instance of the accused4 or the Director of Service Prosecutions5, from any decision of the Court Martial Appeal Court on an appeal to it6, whether given by it when sitting within or outside the United Kingdom7, and also at the instance of the acquitted person or the prosecuting officer, from any decision of the Appeal Court on an application8 for an order for retrial9.
