As from a day to be appointed1, if:
(1) the Court Martial has passed a sentence2 on a person in respect of a service offence3;
(2) that person has, either before or after sentencing for the offence, agreed to give assistance to the investigator or prosecutor of an offence4; and
(3) the person is still serving the sentence5,
the Director may, if he thinks it is in the interests of justice to do so6, at any time refer the case back to the Court Martial7 and the Court Martial may8 substitute for the sentence to which the referral relates such
