Where a person who has been arrested for desertion or absence without leave1 or has surrendered to civilian police2 is brought before a court of summary jurisdiction in a relevant territory3 then if: (1) the person admits to the court that he is a person subject to service law4 who has deserted or is absent without leave; or (2) the court has in its possession evidence of a description prescribed by regulations made by the Secretary of State5, the court must either arrange for him to be transferred to service custody or release him subject to a condition that
