446. Powers of the commanding officer and the Director of Service Prosecutions after charge.

Where a charge against a person ('the accused') is for the time being regarded as allocated for summary hearing1, the accused's commanding officer may:

  1.  

    (1)     amend the charge2;

  2.  

    (2)     substitute for the charge another charge against the accused3;

  3.  

    (3)     bring an additional charge against the accused4;

  4.  

    (4)     discontinue proceedings on the charge;

  5.  

    (5)     refer the charge to the Director of Service Prosecutions5.

Where a charge is referred to the Director, the charge and any other charge brought in respect of the same case are to be regarded for these purposes as allocated for Court Martial trial6. Where a charge is
