Where a person aged 18 or over is convicted by the Court Martial1 of an offence2 of criminal conduct3, and the offence is a serious offence listed for this purpose4, the Court Martial must impose a sentence of imprisonment for life if:
(1) but for these provisions, the Court Martial would5 impose a sentence of imprisonment for 10 years or6 more7; and
(2) at the time the offence8 was committed the offender had been convicted of an earlier listed offence
