(1) there has been an accident involving an aircraft or a ship4 at the time of which the person was carrying out an aviation function in relation to the aircraft or a marine function in relation to the ship5;
(2) there has been an accident involving an aircraft or a ship6 before which the person carried out an aviation or marine function in relation to the aircraft or ship7, and
