579. Costs on appeal.

The Secretary of State1 may by regulations2 make provision empowering the Court Martial Appeal Court3, in any case where the court is satisfied that one party to proceedings before that court has incurred costs as a result of an unnecessary or improper act or omission by, or on behalf of, another party to the proceedings, to make an order as to the payment of those costs4.

Where the Appeal Court allows an appeal it may if it thinks fit, direct the payment by the Secretary of State of costs to the appellant5. The costs which may be directed6 to be paid are such sums a
