A sentence passed by the Court Martial1 takes effect from the beginning of the day on which it is passed2. However this does not apply to: (1) a suspended sentence of imprisonment3 or service detention4; or (2) a sentence passed by the Court Martial on appeal from the Service Civilian Court5. A person sentenced to service detention6 may be detained in service custody7, but may not be detained in a prison and when detained in service custody in pursuance of a sentence of service detention is deemed to be in legal custody8.
