Where an assessor1 is required to assess the amount of compensation payable2 to or in respect of a person for a miscarriage of justice, in assessing so much of any compensation payable as is attributable to suffering, harm to reputation or similar damage, the assessor must have regard in particular to: (1) the seriousness of the offence of which the person was convicted and the severity of the punishment resulting from the conviction; and (2) the conduct of the investigation and prosecution of the offence3.
